COMPREHENSIVE TERMS OF SERVICE

This Agreement is between you (“Client,” “you,” or “your”) and Beyond Driven Enterprises, Inc., a California corporation doing business as “Beyond Driven” and “Recentered Women” (collectively, the “Company,” “we,” “us,” or “our”). Any reference in these Terms to “Beyond Driven” or “Recentered Women” refers to the same legal entity: Beyond Driven Enterprises, Inc. All services, products, programs, and offerings provided under either name are governed by this Agreement.

These Terms govern your use of the website, community platform, and all free educational resources. Specific programs and services are subject to additional terms in their respective agreements.

Acceptance & Scope

By accessing the Beyond Driven website, Circle community platform, or any of our digital properties ("Services"), you agree to these Terms. These Terms apply to all users regardless of whether you purchase programs or access free content.

Additional Program Terms: Specific coaching programs, courses, or paid services are governed by separate agreements presented at the time of purchase, which supplement these general Terms.

Intellectual Property Rights

All content on our Services, including but not limited to text, graphics, logos, images, audio, video, software, methodologies, and compilations, is the exclusive property of Beyond Driven Enterprises, Inc. or its licensors and is protected by copyright, trademark, and other intellectual property laws.

Trademarks

Beyond Driven®, our logo, and all related names, logos, product names, and slogans are trademarks of Beyond Driven Enterprises, Inc. You may not use these marks without our prior written permission.

Copyright Protection

All materials are protected under U.S. and international copyright laws. Unauthorized reproduction, distribution, or creation of derivative works is strictly prohibited and may result in severe civil and criminal penalties.

Limited License & Use Restrictions

PERSONAL USE ONLY: We grant you a limited, non-exclusive, non-transferable, revocable license to access and use our Services for your personal, non-commercial use only.

You May NOT:

Copy, reproduce, distribute, or create derivative works from our content
Use our content for commercial purposes or monetary gain
Reverse engineer, decompile, or disassemble any software or technology
Remove or alter any proprietary notices or labels
Frame or mirror any part of our Services
Use automated systems (bots, scrapers, etc.) to access our Services
Sell, rent, lease, or sublicense any of our content or your access
Create competing products or services based on our materials

Community Guidelines (Circle Platform)

Our Circle community is a private space for members to connect, share, and grow. By participating, you agree to these community standards:

PROHIBITED CONDUCT:

Harassment, bullying, or intimidation
Hate speech, discrimination, or bigotry
Impersonation or misrepresentation
Self-promotion or unauthorized selling
Spam, chain letters, or mass messaging
Pornographic, vulgar, or sexually explicit content
Promotion of competitive businesses or services
Sharing others' private information
Illegal activities or content
Manipulation or misleading information

REQUIRED CONDUCT:

Respect all members
Maintain strict confidentiality
Provide constructive feedback
Report violations promptly
Use real identity (no fake profiles)
Follow moderator instructions
Focus on community growth
Honor intellectual property

Strike System & Enforcement

THREE STRIKE POLICY:

• First Strike: Written warning with specific violation details

• Second Strike: 7-day suspension from community access

• Third Strike: Permanent removal from all Beyond Driven platforms

Severe violations (illegal content, doxxing, threats) result in immediate permanent ban.

Privacy Within Community

Information shared in our Circle community is confidential. Members may not screenshot, record, or share any content or discussions outside the platform without explicit permission from the content creator and Beyond Driven.

Moderation Rights

We reserve the right to remove content, suspend or terminate accounts, and take any action necessary to maintain a safe, respectful community environment. Decisions are final and at our sole discretion.

DMCA Copyright Policy

We respect intellectual property rights and expect our users to do the same. We will respond to notices of alleged copyright infringement that comply with the Digital Millennium Copyright Act (DMCA).

User Content & Licensing

By posting content to our Services (including testimonials, comments, or community posts), you grant Beyond Driven a worldwide, perpetual, irrevocable, royalty-free license to use, reproduce, modify, adapt, publish, translate, distribute, and display such content in any media.

You represent and warrant that you own or have the necessary rights to grant this license and that your content does not infringe any third-party rights.

Educational Purpose & Disclaimers

NOT PROFESSIONAL ADVICE: All content is for educational and informational purposes only. We are not licensed professionals in any field including medicine, psychology, law, or finance.

Medical & Mental Health

Our content is not a substitute for professional medical or mental health advice, diagnosis, or treatment. Always seek the advice of qualified health providers with any questions. Never disregard professional medical advice or delay seeking it because of our content.

Results Disclaimer

Individual results vary significantly. Testimonials and examples are not guarantees of future results. Success depends on individual effort, dedication, background, and many factors beyond our control. We make no earnings claims, return on investment claims, or guarantees of any specific outcome.

Privacy & Data Protection

Your privacy is important to us. Our Privacy Policy, incorporated by reference, explains how we collect, use, and protect your information. By using our Services, you consent to our data practices.

Circle Community Data

Information you share in our Circle community may be visible to other members. Exercise caution when sharing personal information. We are not responsible for other members' use of information you choose to share.

Data Retention

We retain personal data only as long as necessary to provide our Services and fulfill the purposes described in our Privacy Policy. Typically:

Account information: Retained until account deletion plus any legally required period
Transaction records: 7 years for tax and legal compliance
Community content: Until deleted by user or as required by moderation
Marketing data: Until opt-out plus suppression list maintenance

Refund Policy

PROGRAM-SPECIFIC REFUNDS: Coaching programs and services have specific refund terms outlined in their individual service agreements signed at purchase. Contact admin@beyond-driven.com for program-related refund requests.

Digital Products & Merchandise

We offer a 14-day money-back guarantee for digital products and merchandise, subject to these conditions:

Products must be UNUSED (we track digital product access through our activity dashboard)
Request must be submitted within 14 days of purchase
Physical merchandise must be returned in original condition
Shipping costs are non-refundable

Credit Authorization (FCRA)

BREAKTHROUGH CALL APPLICATIONS: By submitting an application to book a breakthrough call, you provide written authorization for Beyond Driven Enterprises, Inc. to obtain your credit profile from reporting agencies under the Fair Credit Reporting Act (FCRA) solely for pre-qualification purposes. This is a soft inquiry that will not affect your credit score.

Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. Notify us immediately of any unauthorized use or security breach at legal@beyond-driven.com.

Third-Party Services

Our Services may contain links to third-party websites or integrate with third-party services (including Circle). We are not responsible for their content, privacy practices, or functionality. Your use of third-party services is at your own risk and subject to their terms.

Limitation of Liability

MAXIMUM LIABILITY: To the fullest extent permitted by law, Beyond Driven's total liability for all claims shall not exceed $100 or the amount you paid us in the 12 months before the claim arose, whichever is greater.

NO CONSEQUENTIAL DAMAGES: We are not liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, revenue, data, or use, regardless of the theory of liability.

Community Interactions

We are not responsible for the conduct of any user in our Circle community or elsewhere. Interactions with other users are at your own risk. We disclaim all liability related to user interactions, including any harm arising from offline meetings or communications.

Indemnification

You agree to indemnify, defend, and hold harmless Beyond Driven Enterprises, Inc., its officers, directors, employees, agents, and affiliates from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

Your violation of these Terms
Your violation of any third-party rights
Your use or misuse of our Services
Your interactions with other users
Content you post or share

Termination

We may terminate or suspend your access immediately, without prior notice or liability, for any reason, including breach of these Terms. Upon termination, your right to use our Services ceases immediately.

Effect of Termination

Provisions that by their nature should survive termination shall survive, including intellectual property, indemnification, disclaimers, and limitations of liability.

Dispute Resolution

Binding Arbitration

Any dispute arising from these Terms shall be resolved through binding arbitration under the American Arbitration Association rules, not in court, except intellectual property disputes or small claims.

Class Action Waiver

YOU WAIVE ANY RIGHT TO BRING CLAIMS AS A CLASS OR COLLECTIVE ACTION. All disputes must be brought in your individual capacity.

General Provisions

Governing Law

These Terms are governed by California law, without regard to conflict of law principles. Venue for any disputes shall be Orange County, California.

Modifications

We may modify these Terms at any time. Continued use after changes constitutes acceptance of modified Terms.

Severability

If any provision is found unenforceable, the remaining provisions continue in full force.

Entire Agreement

These Terms, plus any program-specific agreements, constitute the entire agreement between you and Beyond Driven.
